Probate Litigation and Estate Administration

Our attorneys can represent parties requesting or challenging a will contest. We have experience with probate litigation involving issues such as undue influence, will interpretation, misappropriation of assets, and disputes over administrators, executors or trustees.

We can also assist your family with all types of estate administrations, including small and large estates as well as those with or without wills. When an individual dies and leaves a will, there are two means of transferring his or her property. One is muniment of title. In this case, no administrator or executor is required. For more complex estates, an administrator (or executor) is either appointed by the court or named in the decedent’s will.

When a person dies intestate (without leaving a will), the administration of the estate is more complex. If the estate’s value is less than $50,000, excluding any real estate, you can use a small estate affidavit to transfer the assets to the heirs. For high net worth estates or an estate with significant debt, you will likely need an estate administrator. We can assist your family with this process.
